By registering as a seller on Nualocal, you agree to comply with and be bound by the following Terms and Conditions. Please review these operational rules carefully before activating your account.
1. Marketplace Eligibility & Verification
- Strict “Made in Kenya” Rule: You agree that all items listed in your shop must be designed, processed, or manufactured within Kenya. Imported finished goods are strictly prohibited.
- Payment Credentials: To ensure easier and faster disbursement of funds, you must provide a valid, active M-Pesa phone number in your account settings.
2. Commissions & Transaction Fees
- Flat 12% Commission: Nualocal deducts a flat commission fee of twelve percent (12%) from the item price on every successful customer sale.
- Withdrawal Charges: A flat administrative withdrawal processing fee of KES 50 will apply to each fund payout requested or disbursed from your vendor wallet.
3. Order Processing & Drop-off Logistics
- Drop-off Protocol: Once an order is placed, you must deliver the packaged product to the designated Nualocal Drop-off Point promptly.
- Vendor Expenses: All transit costs and responsibilities involved in moving your inventory from your workshop to the Nualocal Drop-off Point are borne entirely at the expense of the vendor.
4. Packaging & Fragile Protections
- Sourcing Packaging: Product packaging is entirely the vendor’s responsibility. Your goods must be neatly presented in clean, retail-ready materials.
- Fragile Goods Padding: If your products are fragile (such as pottery, beaded art, wood carvings, glassware, or delicate tableware), you must provide secure padding (e.g., bubble wrap, foam, or thick cardboard boxes) to prevent breaks. Items damaged during transit due to poor vendor padding will not be eligible for payout.
5. Fulfillment, Shipping, & Escrow Payout Matrix
- Logistics Engine: All primary long-distance countrywide courier shipping and customer delivery handoffs are handled exclusively by Nualocal once items are safely collected at the drop-off center.
- Payout Schedule: Payout funds are held in escrow for buyer protection. Earnings will be disbursed to your M-Pesa account exactly five (5) days after the customer explicitly confirms successful delivery of the product.
6. Substandard Items, Wrong Deliveries & Penalties
- Product Accuracy: All listed items must match their descriptions, pictures, and quality grade flawlessly. Delivering a product that is substandard, counterfeit, damaged, or entirely incorrect is a direct breach of this agreement.
- Negligence Costs: If an order is returned due to a wrong item shipment or poor quality, the vendor absorbs the entire financial loss. The customer will be refunded immediately.
- Return Shipping & Handling Penalty: The vendor is fully liable for the courier costs of sending the rejected item back to the drop-off center. A standard handling fee of KES 200 will be deducted from the vendor’s wallet to cover Nualocal’s dispatch costs.
- Unclaimed Returns: Returned stock must be collected from the drop-off point within seven (7) days of notification. Unclaimed items will attract a storage penalty fee of KES 50 per day.
7. Limitation of Liability & Indemnity
- Platform Status: Nualocal acts solely as a technological marketplace bringing independent artisans and buyers together. Nualocal does not manufacture or own the products listed by vendors.
- Liability Cap: Nualocal shall not be held liable for any damages, personal injuries, losses, or illnesses resulting from the use or consumption of a vendor’s product.
- Indemnification: The vendor agrees to protect, legal-defend, and hold Nualocal harmless from any lawsuits, financial claims, and legal costs originating from their products or storefront misconduct.
8. Tax Obligations & Regulatory Compliance
- Tax Reporting: Vendors are independently responsible for recording, declaring, and paying any appropriate business taxes to the Kenya Revenue Authority (KRA). Nualocal is only responsible for processing platform commissions.
9. Misconduct & Suspensions
- Attempting to redirect Nualocal shoppers to process transactions privately via external phone or personal payment channels will result in immediate and permanent shop deactivation.
